A Warning Letter from the Texas Department of State Health Service advised ALBAR DEWYN™ that the words “Hair Growth Shampoo and Hair Growth Conditioner" names of my products are implied drug claims. And the labels on both products have claim “helps hair grow longer and stronger” also implies drug claims. So we have to change our labels.
ALBAR DEWYN™ is complying with the warning letter from the Texas Department of State Health Service and has changed the labels to read; “Hair Care Shampoo and Hair Care Conditioner” plus the statement of “helps hair growth longer and stronger” has been removed from the aforementioned products.
I did point out the Texas Department of State Health Service that numerous products online and similar labeled products being sold in beauty supply stores, supermarkets, and drug stores and alike labeled with the titles Hair Growth Shampoo and Hair Growth Conditioner and also Hair Growth Spray. If ALBRA DEWYN cannot use these descriptions then the Texas Department of State Health Service should remove these products from the markets in the Great State of Texas. Why was my company being single out for not in compliance with FDA rule 21CFR310.527?
